DOB Requires New Documents for Mandatory Inclusionary Housing

By Andrew Pisani

Effective August 1, 2018, Owners and developers have new documentation requirements for securing permits and sign-offs on New Building (NB) and Alteration Type 1 (Alt-1) applications at a location designated for Mandatory Inclusionary Housing (MIH).

MIH, enacted in March 2016, calls for the inclusion of permanently affordable housing in medium- and high-density areas that are rezoned to promote new housing production. Such projects now require applicants to provide DOB with the following documents before filing for permits and sign-offs:

  • Permit. Permit notice issued by Department of Housing Preservation and Development (HPD)
  • Sign-Off. Completion notice issued by HPD

To determine whether a project is located in an MIH area, consult Appendix F of the New York City Zoning Resolution.
