NYC Façade Violations Receive Stiffer Penalties

New York City continues to crack down on façade safety violations. In addition to stricter Local Law 11 inspection requirements for the Façade Inspection & Safety Program (FISP), the city has significantly increased filing fees and civil penalties for filing delays and failure to correct unsafe conditions.
Building Façade Fees & Penalties
Filing Fees
- Initial Report – Previously $265, now $425
- Amended/Subsequent Report – Previously $100, now $425
- Extension Request – Previously $135, now $305
Unsafe conditions must be corrected within 90 days of filing a report with an Unsafe status. An amended report must then be submitted within two weeks of repair completion.
Penalties
Penalties go into effect after the filing period ends.
- Late Filing (Initial Report) – Previously $250/month, now $1,000/month
- Failure to File (Initial Report) – Previously $1,000/year, now $5,000/year
Failure to correct an unsafe condition will incur a monthly civil penalty (outlined below) until the unsafe condition is corrected and filed with the DOB.
Year 1 $1,000 per month
Year 2 $1,000, plus $10 per linear foot of shed, per month
Year 3 $1,000, plus $20 per linear foot of shed, per month
Year 4 $1,000, plus $30 per linear foot of shed, per month
Year 5 $1,000, plus $40 per linear foot of shed, per month
Failure to correct SWARMP conditions will incur a civil penalty of $2,000.
