Starting in March 2016, the DOB began issuing DOB violations for energy code infractions. Violations for energy code infractions are Class 2 (major) violations, and carry a penalty unless dismissed by the ECB.
In order to request dismissal, applicants must admit guilt and cure the violation with an approved Certificate of Correction from the DOB. The date of this must be prior to the cure date indicated on the violation.
To cure a violation and avoid penalties, applicants must:
• Correct all violating conditions and submit proof of correction
• Submit a certificate of correction
• Submit a statement in support of certificate of correction (AEU20)
With dismissal, the DOB will waive the penalty.
