First Round of LL 152 Gas Piping Inspections Due by December 31

For owners of buildings in community districts 1, 3, and 10, the first gas piping inspections required by Local Law 152 of 2016 are due by December 31, 2020. The law, which went into effect on January 1, 2020, requires inspection of gas piping systems in all buildings (except those in occupancy group R-3) at least once every four years, per the schedule established in 1 RCNY Section 103-10.

* no later than December 31 every fourth calendar thereafter

Inspections must be conducted by a Licensed Master Plumber (LMP) or a qualified individual working under the direct, continuing supervision of an LMP.

Gas Piping System Period Inspection Reports

Within 30 days of completing the inspection, the LMP must provide the building owner with inspection results. The plumber must use the Gas Piping System Periodic Inspection Report form (GPS1) on the Department of Buildings (DOB) website.

Gas Piping System Periodic Inspection Certification

Within 60 days of the inspection, the property owner must submit to DOB a Gas Piping System Periodic Inspection Certification form (GPS2), signed and sealed by the LMP who conducted or supervised the inspection. At this time, DOB does not charge a filing fee for submission of inspection certifications.

  • If the inspection certification indicates conditions that require correction, the owner must submit a follow-up inspection certification confirming that the conditions have been corrected, signed and sealed by an LMP, within 120 days of the inspection.
  • If the inspection certification indicates that additional time is required to correct the condition(s) identified in the inspection report, the owner must submit a subsequent inspection certification within 180 days of the inspection. Again, this follow-up submission should be signed and sealed by an LMP, confirming that all conditions have been corrected.

Unsafe or Hazardous Conditions

If an inspection reveals unsafe or hazardous condition(s), the LMP must immediately notify the building owner, the utility providing gas service, and the DOB. The owner must correct the condition(s) immediately, in full compliance with the New York City Construction Codes, including any required permits.

Buildings with No Gas Piping

Owners of buildings that do not have gas piping are required to submit a Gas Piping System Periodic Inspection Certification form. A registered design professional must sign and seal the form, confirming that the property does not include gas piping. Owners must submit this inspection certification every four years by the end of the applicable inspection date range, based on the building’s community district.

Buildings with Gas Piping Systems

By December 31, 2020, and within 60 days of the inspection, owners of buildings in community districts 1, 3, and 10 must submit the Gas Piping System Periodic Inspection Certification form (GPS2) through the online portal. The GPS2 form must be signed and sealed by the licensed master plumber who conducted or supervised the inspection.

Buildings without Gas Piping Systems

By December 31, 2020, owners of buildings in community districts 1, 3, and 10 must also submit the GPS2 form through the online portal. For such properties, a registered design professional—not a licensed master plumber—must sign and seal the form, confirming that the building does not include gas piping.

Penalties and Record-Keeping Requirements

Failure to file an inspection certification within the applicable date range may incur a civil penalty of $10,000.

Building owners must maintain all reports and certifications described in 1 RCNY Section 103-10 for 10 years, making them available to DOB upon request.
