DOB Proposed Rule

The DOB is proposing to add two new violation classifications, and to amend another. The new classifications will enable the DOB to ensure public safety and more effectively enforce the laws, rules and Commissioner’s orders related to the safe operation of construction equipment.

A Public Hearing to discuss the proposed changes was held on 3/24/16.

Section of Law Classification Violation Description
28-201.1 Class 1 Unlawful acts. Failure to comply with a law, rule or Commissioner’s order involving construction and/or equipment safety operations.
28-201.1 Class 2 Unlawful acts. Failure to comply with a law, rule or Commissioner’s order involving construction and/or equipment safety operations.
BC 3316.2 & BC 3319.1 [& 27-1054] Class 1 Inadequate safety measures: [Oper’n] Operation of crane/derrick/hoisting [equip] equipment in unsafe manner.
