LL 835a Brings Change for Project Timelines

Over the last few years, a constant theme for the DOB has been change. These changes reflect process and procedure, and often impact project timelines. A new Local Law – 835a will amend the City’s administrative Code in respect to filing revisions for new buildings with major alterations.
835a will have a direct impact for new buildings, especially cases where the client would typically request that the DOB executive office or Hub division allow the project to receive approval by issuing a foundation and excavation permit.
This approval would allow for projects to get started while ironing out the remaining items; overall timelines moved forward, and projects stayed on track with later deadlines and goals. The understanding was that the team of design professionals would continue to work on obtaining the remain items requested from the same examiner.
Under 835a, this changes, with approvals required up front for the full building.
In order to obtain the full new building approval, these changes will also include buildings which are 1, 2 and 3 family, as well as buildings which are less than 7 stories. The DOB has taken the position that 1, 2 and 3 family buildings , along with buildings less than 7 stories should not be in the same category as the high rise buildings and thus be challenged differently.
